审讯中影响口供证明力的因素研究

摘　　要：口供证明力是指评价口供对待证事实的证明力度,是法官裁量案件的主要依据。随着国家法制建设的不断加强,对进入审判程序的口供证明力的要求越来越高,有些口供尽管符合证据合法性的要求,但证明力并不强。一些案件常常因口供的证明力问题导致案件审理时间延长,致使诉讼效率降低,甚至败诉。调查发现审讯阶段的做法对口供证明力有较大影响,具体表现在审讯人员自身的素质、口供本身的内容、对主观要件的证明以及是否及时固定口供等。建议从审讯环节入手,强化审讯人员的证据意识并提高其讯问的专业水平,讲究方法,灵活运用审讯策略,同时探讨运用犯罪心理测试技术作为辅助手段提高口供证明力的应用前景。The evidential force of confession refers to the evaluation of the strength of the testimony,which is the main basis of judge's discretion.With the development of national legal system,the burden of proof of confession in trial procedure is more and more high.Some confession accords with the requirement of legality,but the burden of proof is not strong.In some cases,the probative power of confession often leads to the extension of the trial time,which reduces the efficiency of litigation and even leads to failure.The survey found that the practice at the trial stage had a greater impact on the probative power of the confession,specific performance in the interrogation personnel's own quality,the confession itself,the subjective elements of the proof and whether the timely fixed confession and so on.It is suggested that we should start with the interrogation process,strengthen the interrogators'awareness of evidence and improve their professional level of interrogation,pay attention to methods and flexibly apply interrogation strategies.At the same time,the application prospect of using the technology of criminal psychological test as an auxiliary means to improve the probative force of confession is discussed.
