论我国农村宅基地退出的立法构造

摘　　要：现行农村宅基地管理的法律间存在冲突。正在进行的农村宅基地制度改革,其关键是将改革试点区域探索的新经验、新做法与国家层面的立法相结合,确保"可复制、可推广"的改革成果能落实转化为法律。制定农村宅基地退出的法律法规,可以弥补我国农村宅基地专门立法的空白,依法维护宅基地使用权人的用益物权,构建集约、节约利用土地的机制,有利于保护十八亿亩耕地红线。制定农村宅基地退出的法律法规,农村土地改革试点区的新经验新做法可以提供借鉴,立法中的政法传统可以提供理论支撑,农村宅基地自发规则和秩序可以成为实践基础,发现法律可以成为法律创新手段。我国农村宅基地退出管理立法应包括农户宅基地退出遵循的原则、农户宅基地退出的申请与审核、农户宅基地退出的补偿、农户宅基地的收回、法律责任等内容。There are conflicts among the current laws on the management of rural homesteads.The key to the ongoing reform of the rural homestead system is to combine the new experiences and practices explored in the pilot areas of reform with the legislation at the national level,so as to ensure that the“reproducible and extendable”reform results can be implemented and transformed into laws.Formulating laws and regulations on the withdrawal of rural homesteads can make up for the gaps in the special legislation on rural homesteads in China,protect the usufructuary rights of homestead users in accordance with the law,build a mechanism for intensive and economical use of land,and help to protect the red line of 1.8 billion mu of cultivated land.To Formulate laws and regulations on the withdrawal of rural homesteads,new experiences and new practices in the pilot areas of rural land reform can provide reference,the political and legal tradition in legislation can provide theoretical support,the spontaneous rules and order of rural homesteads can become the basis for practice,and legal discovery can become a means of legal innovation.China's rural homestead withdrawal management legislation should include the principles followed by farmers'homestead withdrawal,the application and reviews of farmer's homestead withdrawal,the compensation for farmer's homestead withdrawal,the recovery of farmer's homestead,legal liabilities and so on.
