民汉双语诉讼司法实践研究

摘　　要：民族语言文字使用权在诉讼中表现为一种诉讼权利。为了充分保障当事人在诉讼中使用民族语言文字的权利,促进建立符合诉讼原理的民汉双语诉讼模式,对民汉双语诉讼庭审情况进行了调查。从中国庭审公开网上选取少数民族聚居的西藏自治区、新疆维吾尔自治区、内蒙古自治区及青海省、甘肃省的人民法院公开庭审视频,观察庭审活动中民族语言使用状态,对庭审视频中的民汉双语运用状态进行观察与分析,提出民汉双语诉讼司法实践中存在的问题和解决方案。Being able to use national languages is a right in litigation.In order to fully guarantee the right of the parties to use national languages in litigation,and to promote the establishment of a bilingual litigation model that conforms to the principles of litigation,an investigation was conducted on the court proceedings in bilingual litigations.This article selects the public trial videos of the people’s courts in Tibet Autonomous Region,Xinjiang Uygur Autonomous Region,Inner Mongolia Autonomous Region,Qinghai Province,and Gansu Province where ethnic minorities live in compact communities as research subjects.Usages of ethnic languages and Mandarin Chinese in court trials are observed and analyzed,and problems and countermeasures are proposed.
