认罪认罚从宽制度的新发展——《关于适用认罪认罚从宽制度的指导意见》解析

摘　　要：2019年10月《关于适用认罪认罚从宽制度的指导意见》的出台,标志着我国认罪认罚从宽制度的新发展。《指导意见》进一步明确了认罪认罚从宽制度的一些内容,包括认罪认罚从宽制度的重大意义,认罪认罚从宽制度的四项基本原则,认罪认罚从宽制度适用范围、适用条件等。《指导意见》强化了权利保护的规定,提出了"有效法律帮助"的要求,在强化被追诉人权利的同时也加强了对被害方权益的保障。此外,《指导意见》还细化了职能部门的职权,填补了相关制度的若干空白。《指导意见》的出台推动了认罪认罚从宽制度的发展,但不是发展的终结,在认罪认罚从宽制度新发展的基础上,仍存在一些需要研究解决的问题。The promulgation of the Guiding Opinion on the Application of the Leniency System of Pleading Guilty and Accepting Punishment marks the new development of the system.The Guiding Opinion further clarified certain contents of the system,including the significance of the system,the four basic principles of the system,and the scope and conditions of the cases applicable of the system.The Guiding Opinion strengthened the provisions on the protection of rights and put forward the requirement of"effective assistance of counsel".While strengthening the rights of the defendant,the Guiding Opinions also strengthened the protection of the rights and interests of the victims.In addition,the Guiding Opinion also detailed the function and power of judicial departments,and filled several gaps in the relevant system.The introduction of the Guiding Opinion is not the end of the development of the system.On the basis of this new development of the system,there are still many problems that need to be studied and resolved.
