摘 要:在新时代司法改革背景下,检察机关的内设机构也应司法改革及实践的需要,调整捕诉之间的关系,将侦查监督部和公诉部合并为一个部门,即"捕诉合一",具体是指在公诉案件中由检察机关的员额检察官或办案组负责同一案件的批捕和审查起诉工作。对于检察机制改革,无论是"捕诉合一"还是"捕诉分离",都不应仅仅在某一层面进行利弊分析,而是应基于本国的国情、司法改革和实践需要及能推动社会发展等层面进行考虑,从理论和实务中寻找合适新时代中国特色检察机制的道路。In the context of judicial reform in the new era,the internal organs of procuratorial organs also adjust the relationship between arrest and prosecution in accordance with the needs of judicial reform and practice,and the department of investigation supervision and the department of public prosecution are merged into one department,that is,"unity of arrest and prosecution".Specifically,it means that the posted prosecutor or case handling team of procuratorial organs is responsible for the same case's arrest and examination and prosecution.For the reform of procuratorial mechanism,whether it is"unity of arrest and prosecution"or"separation of arrest and prosecution",we should not only analyze the advantages and disadvantages at a certain level,but also consider these based on the national conditions,judicial reform,practical needs and the promotion of social development,so as to find a suitable way of procuratorial mechanism with Chinese characteristics in the new era from both theory and practice.
