摘  要:结合我国2018年修订的《农村土地承包法》有关承包地经营权抵押、流转的制度安排,承包地经营权抵押权实现在很大程度上无法适用我国现行物权法规定的折价、拍卖、变卖等方式,更多时候需要采取创新的实现方式。可以将出租(转包)、入股等流转方式和托管确立为承包地经营权抵押权实现的创新方式。在承包地经营权抵押专门立法中,借助农村土地制度的概念体系来构造承包地经营权抵押权实现方式的相应规则,是一种较为可取的做法。In conjunction with the institutional arrangements of mortgage and circulation of manage-ment right of rural contracted land in the law of the PRC on land contract in rural areas revised in 2018,such modes as discount,auction and sale which stipulated in the real right law of PRC could not be applied to realize the mortgage of Management right of rural contracted land to a large extent,and it is necessary to take innovative modes in most time.Circulation means such as Lease(subcontract)contribution,and trusteeship could be established as innovative modes of realization of the mortgage of Management right of rural contracted land.In the special legislation on the mortgage of Management right of rural contracted land,it is an advisable practice to construct the rules of the realization modes of the mortgage of Management right of rural contracted land by establishing the concept system of rural land system.
