摘　　要：互联网电子证据的出示是指互联网电子证据应当以何种方式在法庭上展示,其主要包括出示范围、出示形式、出示内容等要素。互联网电子证据的依赖性,导致不同的出示方式包含不同的信息总量,亦导致截然不同的出示效应和后果。互联网电子证据的出示形式,与最佳证据规则存在密切关系;大数据的出现影响互联网电子证据相关性的判定进而影响出示范围。从实用主义视角出发,现有互联网电子证据的出示规则,应当从出示形式的变换、出示范围的厘清及出示内容的限缩三方面加以完善。The production of Internet evidence refers to the form of producing Internet evidence in court,and it mainly contains the production scope,the production form,the production content and so on.Due to the subsidiary nature of Internet evidence,different production forms may contain different data,and it will lead to distinct consequences.The production form of Internet evidence is closely related to the best evidence rule,and the emergence of big data makes several changes to the review mode of relevance.And it is in this way that the scope of production will be influenced.From the perspective of pragmatism,the existing production rule of Internet evidence should be improved from three aspects,namely the alteration of production form,the clarification of production scope and the limitation of production content.
