摘　　要：作为法理学研究的中心主题,“法理”已获得了法学研究者的共同关注。研究“法理”不仅能勾勒出中国法理学发展的理想图景,甚至在一定程度上也可以回答“中国法学向何处去”的追问。将“法理”确认为法理学的研究对象不仅能促进法理学知识体系的重大更新,而且能为论争不断的法理学定分止争,更能促进法理学与部门法学的良性互动,进一步引导法理学走向实践。但是,将“法理”作为法理学的理想图景还存在着许多问题和挑战,法理学界需要在反思与批判的基础上,进一步厘清“法理”的内涵与外延,探讨将“法理”从概念上升为研究范式的可能性。因此,必须坚定“法理”自信,解除法理学的“身份焦虑”;寻求“法理”的本土资源,树立“法理”中国观;在尊重“法理”自身规律的前提下,重视“法理”的方法论塑造;确立“法理”与“法理学”的实践立场,寻求“法理”发展的多种可能性。As the central theme of jurisprudence research,"Fali"has received common attention from legal researchers. Studying"Fali"can not only give an outline for the prospect of the development of Chinese jurisprudence, even to a certain extent, it can answer the question of"where is China’s law going?". The recognition of"Fali"as the research object of jurisprudence can not only promote the major renewal of knowledge system in jurisprudence, but also stop the controversy of jurisprudence, promote the positive interaction between jurisprudence and the branch laws, and further guide jurisprudence to practice. However, there are still many problems and challenges in using"Fali"as the ideal picture of jurisprudence. On the basis of reflection and criticism, the jurisprudential circle needs to further clarify the connotation and extension of"Fali"and explore the possibility of upgrading"Fali"from concept to research paradigm. Therefore, it is necessary to strengthen the self-confidence of"Fali"and relieve the"identity anxiety"of jurisprudence;seek the local resources of"Fali"and establish the Chinese"Fali"view;pay attention to the methodological shaping of"Fali"on the premise of respecting its own laws;establish the practical standpoint of the"Fali"and"jurisprudence", and finally seek multiple possibilities for the development of"Fali".
