摘 要:在精准扶贫战略驱动下,食用菌栽培在许多农村地区兴起,并成为了提高当地农户家庭经济福利的重要产业。在政府支持背景下考察食用菌市场的创新活动,其中含有2个重要要素:对食用菌资源的重构与整合,以及在食用菌市场中获得红利。为此,在市场创新过程中将面临3类风险,对风险实施法律规制的途径为:培育县域政府有关人员正确的行政法权意识、基于民法通则保障食用菌栽培主体合法权益、基于合同法强化合约管理维系集群内部秩序、基于财经法规和协商确定公共基金提留办法。Driven by the targeted poverty alleviation strategy,edible fungi cultivation has emerged in many rural areas and has become an important industry to improve the economic welfare of local farmers.In the context of government support,the innovation activities of the edible fungi market are examined,which contains two important elements:the reconstruction and integration of edible fungi resources,and the dividends obtained in the edible fungi market.To this end,there will be three types of risks in the process of market innovation.The ways to implement legal regulations on risks are:to cultivate the correct administrative legal awareness of the relevant personnel of the county government,to protect the legitimate rights and interests of edible fungi cultivation subjects based on the general rules of civil law,and based on the contract law contract management maintains to strengthen the internal order of the cluster,and determines public fund retention methods based on financial regulations and negotiation.
