摘 要:通勤事故工伤认定离不开公安交警部门的事故认定书,事故认定书的证据属性,决定着人力社保行政部门在工伤认定过程中必须严格审查其证据的“客观性、关联性、合法性”,对不符合三性标准的认定书应当予以排除。同时,对“事故责任无法认定”的事故证明,应当具体情形具体分析,不能一概予以接收或排除。The industrial injury identification in commuting accidents can not be separated from the accident identifi cation certifi cate issued by the traffi c police departments.The evidence attribute of the accident identification document determines that the human resources and social security administrative department must strictly examine the objectivity,relevance and legality of the evidence in the process of industrial injury identifi cation.It is necessary to exclude those who do not meet the three standards.At the same time,the accident certifi cates that cannot be identifi ed should be analyzed according to the specifi c circumstances,and can not be accepted or excluded.
