摘　　要：刑法在罪状的描述中采用了大量的需要司法者价值判断的规范构成要件要素,主要包括法律评价要素、经验法则评价要素及社会评价要素等三类,对规范的构成要件要素的司法诠释决定了具体案件事实和刑法规定的符合性判断。由于语言的限制,规范构成要件要素中可能包含不值得科处刑罚的行为,因此必须秉持谦抑理念,采用实质解释的立场限制对规范构成要件要素的解释。对法律评价要素要限制法律法规的范围,对相关法律法规保护法益是否与刑法保护法益相同做实质判断;对经验法则评价要素要注重专业的判断;对社会评价要素要以法益保护为导向,根据社会发展而相应变化。The criminal law has adopted a large number of normative elements in the description of the crime,which require the judicial value judgment,It mainly includes three kinds of legal evaluation elements,empirical evaluation elements and social evaluation elements,The judicial interpretation of the elements of the constitution of norms determines the judgment of the conformity of the facts of specific cases and the provisions of criminal law.Due to the limitation of language,the elements of normative elements may contain ACTS that are not worthy of punishment,Therefore,it is necessary to hold the idea of modesty and restraint,and to limit the interpretation of the elements constituting the standard from the standpoint of substantive explanation.We should limit the scope of laws and regulations and make substantive judgment on whether the interest in the protection of relevant laws and regulations is the same as that in the protection of criminal law.Professional judgment should be paid attention to the evaluation elements of the rule of thumb.The social evaluation elements should be guided by benefit protection and changed according to the social development.
