摘  要:针对航空公司提供的航班延误补偿措施及保险公司的“延误险”,多地出现利用专业软件预判航班准点率,然后使用本人及他人身份证多次购买机票及保险,获取高额赔(补)偿金的情形。这类行为涉及恶意复保险、隐瞒真实风险以及利用虚构事实骗取合同当事人财物等犯罪行为,危害了保险和市场管理的正常秩序。对此,应当认真分析具体案情,准确定罪量刑,有效保障市场经济秩序的有序开展。Targeted at the compensation given by the airliners for flight delays and the“flight delay insurance”provided by insurance companies,the cases to obtain large amount of damages by predicting the airline on-time performance through professional software before booking the flight tickets and insurance multiple times by using different ID cards have been reported in many places.Such cases are involved in the malicious behaviors of double insurance,risk information concealment and insurance fraud by fabricating the object,which are hazardous for the order and management of insurance market.Therefore,the case details should be analyzed for conviction and punishment to restore the market economic order.
