摘　　要：我国卫生健康事业需要政策支持,更需要在法治轨道上发展。《中华人民共和国基本医疗卫生与健康促进法》的颁布,是我国医疗卫生事业发展的强有力推动和对"大健康"理念的回应。以此为背景,回顾其立法背景与历程,阐释其立法多重意义,并以"健康促进"为切入点,从医疗资源分配公平环境改善与健康促进、健康促进与医患矛盾化解等方面展开具体论证与法律条款解读。《中华人民共和国基本医疗卫生与健康促进法》在一定程度上统合了中国的医学伦理发展方向,但在下一步还要致力于完成从医学伦理到医患伦理的深层统合,成为"健康中国"战略的法治推动力。The development of health service in China needs policy support,but also needs to develop on the track of rule of law.The promulgation of the Basic Health Care and Health Promotion Law is a powerful push for the development of China’s medical and health undertakings and a response to the concept of"great health".Based on this background,this study reviewed the legislative background and process,explained the multiple meanings of legislation,and took"health promotion"as the entry point to carry out specific demonstration and interpretation of legal provisions from the perspective of medical resource allocation,fair environment improvement and health promotion,health promotion and doctor-patient conflict resolution,etc.The Basic Health Care and Health Promotion Law has integrated the development direction of medical ethics in China to a certain extent,but in the next step,it should be devoted to complete the deep integration from medical ethics to doctor-patient ethics,and become the legal driving force of the strategy of"Healthy China".
