摘　　要：近年来,城市管理领域出现的各种执法困境,比如选择性执法、功利性执法以及被动性执法等,从根源上讲都是因执法价值冲突所致。基于此,我们从效率与控权来分析不同价值维度组合形态下的各种执法模式,并依据"强控权、高效率"分析框架,提出城市管理领域行政执法要摒弃技术效率与形式法治价值标准,要在推进城市管理立法、执法过程中构建多元主体商谈机制,进一步改革执法制度环境,推进财政分配制度与执法绩效考核改革,增强执法目标与党的执政理念、政府治理目标之间的有效契合,积极构建城市管理领域跨部门横向协同框架机制和执法自由裁量基准制度,强化执法监督责任制度落实。In recent years,all kinds of law enforcement dilemmas in the urban management are originated from value conflicts.This article analyzes various law enforcement modes from the perspective of"control and efficiency".Under the framework of"strong control and high efficiency",it’s proposed that in urban management law enforcement technical efficiency and formal rule of law should be abandoned,that multi-subject negotiation mechanism should be built in urban management legislation and law enforcement,law enforcement conditions should be improved,the fiscal distribution system and the performance evaluation system in law enforcement should be reformed,law enforcement objectives,the Party’s governance philosophy and the government governance goals should be integrated,department cooperation mechanism and a discretionary criterion system should be built up,and the supervision of law enforcement should be strengthened.
