海南自由贸易港有关航运产业发展方面的立法建议——基于对新加坡海事海商法律体系的梳理

摘　　要：较为完善的海事海商法律体系和能够为解决海事纠纷提供及时有效的司法和法律服务的生态系统,是新加坡能够迅速发展成为全球海上航运枢纽和高水平自由贸易港的关键。我国现行《海商法》存在的立法缺陷对我国各自由贸易试验区航运产业的发展构成了严重制约。建议将来的海南自由贸易港立法除了在立法框架上单独设立"航运服务"章节,在内容安排上,借鉴新加坡经验,对标和对接国际通行规则,对航运产业发展从政策引导支持到提供海事海商法律体系支撑作出科学全面安排,为海南自由贸易港航运业发展构筑较为完善的法律体系保障。A relatively complete maritime legal system and an ecosystem capable of providing timely and effective judicial and legal services for the settlement of maritime disputes are the key to the rapid development of Singa.pore into a global maritime shipping hub and a high-level free trade port. The legislative deficiencies in The Mari.time Code of the People’s Republic of China have severely restricted the development of the shipping industry in China’s pilot free trade zones. Therefore, it is suggested that"shipping services"should be set up as a separate chapter in the legislative framework. Meantime, the legislation for Hainan Free Trade Port is suggested to draw on Singapore’s experience in terms of legislative contents, referring to and aligning with the prevailing international rules. Furthermore, the scientific and comprehensive regulations should be made for the development of the ship.ping industry, which range from the policy guidance and support to the guarantee for the maritime legal system, so as to build a more comprehensive maritime legal system for the development of the shipping industry in Hainan Free Trade Zone.
