论严格排除非法证据规则下的有效辩护

摘　　要：严格排除非法证据规则的出台,为排除非法证据辩护带来了良好的司法环境,我国虽没有正式确立有效辩护的规定,但是引入有效辩护理念有利于辩护律师恪尽职守,充分保障非法取证案件中被告人的权利救济。严格排除非法证据新规则申明了律师进一步可辩护的范围,中国司法理论与实践的不断完善证明我国确有引入有效辩护理论的必要,辩护律师应协调当事人和法院做好配合工作,在具体排除非法证据程序中实现有效辩护。The strict rule of excluding illegal evidence has brought a good judicial environment for the defense of excluding illegal evidence.Although there is no formal regulation of effective defense in China,the introduction of effective defense concept is conducive to the defense lawyers'conscientious duty,and can fully protect the defendant's right relief in the case of illegal evidence collection.The new rule of strictly excluding illegal evidence states the scope of lawyers'further defense.The continuous improvement of China's judicial theory and practice proves the necessity of introducing effective defense theory.Defense lawyers should coordinate the cooperation between the parties and the court to realize effective defense in the specific procedure of excluding illegal evidence.
