引诱、欺骗方法所获供述排除标准研究

摘　　要：基于审讯具有对抗性,引诱、欺骗方法在获取犯罪嫌疑人供述、突破案件过程中具有使用的必要性。基于统一法律内部结构逻辑以及保障口供真实性、维护司法公正的需要,应当对使用引诱、欺骗方法所获供述进行排除,但这种排除,应以认罪自愿性标准为主,辅之以必要性标准。认罪自愿性标准是指考察讯问人员使用的引诱、欺骗方法是否可能对被讯问人的心理造成过度影响、导致被讯问人违背真实意愿而作出虚假的认罪供述;必要性标准作为辅助标准,仅在讯问人员的引诱、欺骗对被讯问人的心理产生了较强的影响,而作出了有罪供述,且该供述经其它证据佐证了其真实性才适用。必要性标准赋予了法官一定的自由裁量权,需要法官在维护个案公正与维护程序公正、司法公正之间进行价值判断。For the fact that the interrogation is antagonistic,the methods of luring and deceiving are necessary in obtaining the confession of criminal suspects.However,with the need of unifying the internal structure logic of the law,ensuring the authenticity of confessions and maintaining judicial justice,confessions obtained by the way of luring and deceiving should be excluded,while such kind of exclusion should be based on the voluntary standard of confession,and supplemented by the necessity standard.Voluntary confession standard refers to judging whether the luring and deceiving methods used by the interrogators may have excessive influence on the psychology of the interrogated person and lead to false confession.As an auxiliary standard,the necessity standard is applicable only when the luring and deceiving of the interrogators have a strong influence on the psychology of the interrogated person to make a guilty confession,and the confession has been proved to be true by other evidences.The necessity standard endows judges with certain discretion,which requires judges to make value judgement among the case justice,the procedure justice and the judicial justice,and to consider the necessity of excluding the evidence.
