检察机关公诉环节自行侦查权的检视与完善

摘　　要：公诉环节自行补充侦查虽然不是刑事案件必须经过的诉讼程序,但它有利于检察机关充分行使控诉权、实现亲历性审查、强化法律监督。实践中,自行侦查权由于性质定位不准、适用标准及操作程序不全以及检察人员能力不足、协作机制不完善等原因,没有实现其应有的诉讼价值。为解决这一问题,应当进一步明确公诉环节自行侦查权的性质定位,在立法上对自行补充侦查情形予以规定和限制,在实践中引导检察人员树立正确司法理念,提升自行侦查能力,健全对自行侦查权的监督机制及配套工作机制,从而最大限度发挥其应有的效能,促进公平正义司法价值的实现。Though the independent investigation in public prosecutions is not the required procedure in the criminal cases,it is of great significance for the procuratorial organs to fully exercise the right of prosecution,realize on-the-scene review and strengthen the legal supervision.However,in practice,due to inaccurate nature positioning,incomplete applicable standards and operating procedures,inefficiency of the procurators,imperfect coordination mechanism and other reasons,the right of independent investigation is hardly applicable and fails to realize its due litigation value.To address these problems,it is crucial to further clarify the nature of the right of independent investigation in the public prosecutions and to regulate and restrict the circumstances of independent supplementary investigation.Meanwhile,in practice,procuratorial personnel are required to build up sound judicial ideas and improve their independent investigation skills.Supervision on the independent investigation and supporting mechanisam should be strengthened.Only in this way can we maximize its due efficiency and realize fair justice.
