摘 要:随着互联网文化娱乐活动的不断扩展,由网络游戏引发的法律争议越来越多。游戏玩家在网络游戏参与过程中所创立的账号,以及依托游戏和账号形成的虚拟角色、虚拟货币、虚拟装备等虚拟财产,理应受到法律的有效保护。而游戏服务商基于对网络游戏空间的维护和治理,对不良游戏玩家采取账号封停等监管措施,有其必要性,但是要尽可能秉持权责平衡原则。如果游戏服务商忽视游戏玩家的主观过错程度、行为严重程度、封号的通知和异议程序等因素,简单粗暴地对游戏玩家进行封号、没收虚拟财产等处理,可能构成违约行为和侵权行为的竞合,游戏玩家可以提起违约之诉或侵权之诉。With the development of Internet entertainment, the number of disputes arising from online games is growing. The accounts created by game players and the virtual properties, including virtual roles, currency and equipment, shall be under the effective protection of the law. Though it is necessary for game service providers to take regulatory measures, such as suspending the accounts, for the purpose of maintaining and governing the online game space, it must be mentioned that they should uphold a balance between power and responsibility. If they lay little emphasis on the subjectivity and severity of the players’ fault, the notification of account suspending and objection procedure, but suspend the accounts and expropriate the virtual properties in a simple and crude way, they may break the contract and infringe the players’ rights. The game players can initiate legal proceedings for the breach or infringement of the game service providers.
