摘　　要：水生态空间概念不清、范围不明、权属界定缺失是当前水流产权确权的薄弱环节,解决以上问题对健全水流产权确权制度、完善水资源管理和维护水流健康至关重要。在梳理水资源、水体、水流等相关概念的基础上,对水生态空间内涵进行界定。基于水生态空间划界确权进程和试点建设情况,总结了现状存在的问题,并以河流为例探索水生态空间划界方法,提出水域、岸线空间内土地所有权和用益物权界定的建议。Lacking of clear definition of water ecological space,scope,and ownership has become a weak link for the definition of water flow entitlement.The solution for the problem is crucial for the improvement of property right confirmation system of water flow,water resources management and maintaining of river health.Based on review of concepts of water resources,water body and water flow,the connotation of water ecological space is defined,with summary of existing problems,methodologies of water ecological space delimitation by taking river as an example.Finally it makes suggestions for determining land ownership and property right in water area and scope of shoreline.
