摘　　要：人民法院高效、公正的裁判是司法正义的灵魂,创新优化审判绩效考核方法是审判责任终身负责制改革的关键,要求“审理者裁判、裁判者负责”。各级人民法院已逐步采用智能化审判系统管理办案流程,但该系统无法记录参与办案的员额法官和审判辅助人员的贡献,导致团队管理较难。根据对S县人民法院长达数月的深入调查,基于扎根理论完成对员额法官和审判辅助人员的全部履责行为价值统计,据此提出了一种新型的行为价值法统计评价方法,将“管理审判团队”转化为“管理履责行为”,以此优化设计了S县人民法院的审判绩效管理系统。这种新型的考核方法不仅为员额法官和审判辅助人员提供了履责行为价值的绩效统计,更为其提供了业务能力提升方向,具有良好的应用价值。Efficient and fair judgment is the soul of judicial justice for people’s court.Optimizing trial performance appraisal method is crucial to facilitating the reform of life-long judicial responsibility,that is to say,“A case is judged by judicial judge and responded by the same judge.”Courts at all levels have introduced intelligent trial information system(ITIS)to manage judicial process.However,there are no ways in the ITIS to record the contribution of the judicial judges and ancillary personnel participating in trials.It leads to difficulties in team management.Thus a comprehensive investigation has been conducted for months in the People’s Court of S County.All the important liability behaviors values are found out based on the grounded theory.A new appraisal method of behaviors values law statistic(BVLS)is introduced here for“managing liability behavior”instead of“managing judicial team.”Then ITIS gets optimal designed in the People’s Court of S County.The new method offers not only the performance statistics on liability behaviors values of the judicial judges and ancillary personnel,but also specific direction on improving the professional ability.It greatly contributes to the practice.
