摘　　要：西南少数民族传统的婚姻习俗较易导致重婚现象,地方行政和司法机关在处理该问题的过程中基本尊重了民族习俗。一方面,对传统婚姻习俗进行改革,从而使少数民族的重婚现象逐渐减少;另一方面,执法部门在认定和处理少数民族的重婚行为时都较为慎重,大多是进行思想教育、解除非法重婚关系。即便是处理由重婚行为引发的刑事犯罪时也多采用调解方式,较少采用刑法规制。但直到今天,少数民族地区普遍的早婚、婚姻不登记和事实婚姻等原因使重婚现象依然一定程度地存在着,因此,解决重婚问题的一个重要途径就是从法律、教育、文化等方面对少数民族传统婚姻习俗进行因势利导的综合治理。The traditional marriage custom of the southwest minority is easy to lead to bigamy,and the local administration and judicial organs basically respect the national customs in dealing with this problem.On the one hand,the traditional marriage customs have been reformed so that the phenomenon of bigamy among ethnic minorities has been gradually reduced;on the other hand,law enforcement agencies are more cautious in identifying and dealing with the bigamy behavior of ethnic minorities,mostly conducting ideological education and dissolving the illegal bigamy relationship.Even when dealing with the criminal crimes caused by bigamy,mediation is more often used than criminal law regulation.However,the phenomenon of bigamy still exists to a certain extent due to the widespread early marriage,unregistered marriage and de facto marriage in minority areas.Therefore,an important way to solve the problem of bigamy is to make use of the law,education,culture and other aspects to guide and control the traditional marriage customs of ethnic minorities.
