摘　　要：按照“归属清晰、权能完整、流转顺畅、保护严格”的目标,结合宅基地产权特点,深入研究确定三权权能、权利边界及其相互关系的法律法规保障体系。厘清农民集体、占有和使用主体在宅基地流转、抵押、转让、租赁、入股期限内占有、使用、收益、处分的权利边界及相互权利关系,明晰宅基地“产权束”中各项权能内涵,有序推进各项权能分置运行,激励各主体利用好土地的各项权能。According to the goal of“clear ownership,complete power and function,smooth circulation and strict protection”,combined with the characteristics of homestead property rights,this paper makes an in-depth study on the legal and regulatory guarantee system to determine the power and function of the three powers,the boundary of rights and their mutual relations.Clarify the rights boundary and mutual rights relationship of farmers’collective,possessor and user during the period of homestead transfer,mortgage,transfer,lease and share,clarify the connotation of various powers and functions in homestead“property right bundle”,promote the separation of powers and functions in an orderly manner,and encourage all subjects to make good use of the various powers and functions of land.
