作为交往活动领域根本价值的正义概念

摘　　要：依据人类实践活动原则的不同,可以将生存空间划分为实在对象领域、交往活动领域和内在体验领域。正义作为揭示交往活动原则的规范性范畴,具有不同于事实性范畴和感受性范畴的基本性质。在交往活动领域,道德基本价值是利他性的奉献,而政治基本价值是公平性的平等,两者分别围绕着德性和权利构成交往活动领域的基本价值,但它们本身都还不是正义。正义是在个体主体性权利得到承认的基础上超越个体立场对他者的奉献,是利他德性和平等权利相统一的价值,因此是交往活动领域的根本价值。正义价值的形成需要主体性的共在意识、平等权利基础上的同情心以及作为二者统一的正义感。正义感就是在权利平等基础上与他者分享善品和分担不良事物的共在精神。According to the different principles of human action,the existent space can be divided into the sphere of objective reality,the sphere of communicative action and the sphere of internal experience.As a normative category that reveals the principles of communicative action,justice has the properties different from the categories used in the sphere of objective reality and internal experience.In the sphere of communication action,the basic value of moral behavior is altruistic dedication,while the basic value of political behavior is equality of fairness.Both of dedication and equality constitute the basic values of communicative action respectively around virtue and right,but neither of them is justice in itself.On the basis of the recognition of individual's subjective rights,justice means the dedication to the others beyond egocentrism,and is the value synthesized with altruistic virtue and equal rights.So,this paper argues that justice is the fundamental value in the field of communicative action.The view of justice consists of the consciousness of co-existence,the compassion on the basis of equal rights,and the sense of justice as the synthesis of the two.The sense of justice is the spirit of sharing things with others on the basis of equal rights.
