摘 要:法学教育既要立足于书本,同时还要面向职业实践。对于怎样才能取得良好的法律职业教育效果,当前法学界、教育学界大多聚焦于探讨如何完善、改进大学法学教学。从社会学的视角看,广义的教育应当是一个个体“社会化”的全过程,仅仅将职业化教育局限在学院教育阶段,难免自我局限了研究的视野。通过对x市执业五年内的296位青年律师的实证调查,可以发现,法律职业化教育不仅需要学院教育的基础,也离不开职业实践中的“社会化”教育,二者不能相互替代,应当协同并重,要明确学院教育与职业教育的分工与定位,重视青年律师的职业培训与职业教育。Legal education are based on books and oriented to professional practice simultaneously.On the issue of improving professional legal education,most scholars in the academia of both law and education only focus on exploring the improvement of the teaching methodology of legal education at universities and colleges.From the perspective of sociology,education,in a broad sense,is an entire process of an individual’s“socialization”,which restricts professional education to college education and will inevitably limit itself on the research horizon.Through an empirical study of 296 young lawyers who have practiced in X city for five years,this article finds that professional legal education not only requires the foundation of college education,but also cannot be separated from the education of“socialization”in professional practice,which is necessary to pay equal attention to coordination.In the meantime,it should be clarified on the division of labor and positioning of college education and professional education and stress the professional training for young lawyers.
