摘 要:我国刑事立法将搜查程序定位为刑事侦查措施的一种,侦查权单向权力运行逻辑与侦查机关内部行政审批机制为我国搜查制度的健康运行埋下隐患。目前,我国搜查制度存在程序启动条件缺失、格式性搜查证规定泛化、执行程序规定稍显粗陋、程序监督机制乏力、程序救济体系不明等问题。我国应当借鉴域外搜查制度经验,构建司法化、精密化、保障性的搜查制度体系,从我国司法实际出发,重构搜查程序体系类型,细化搜查程序适用规范,强化搜查程序外部监督机制,构建相对人程序救济机制和程序制裁机制,以完善刑事搜查制度,保障相对人权益,维护程序正义。The criminal legislation positions the search procedure as a kind of criminal investigation measure in China.The one-way power operation logic of the investigative power and the internal administrative approval mechanism of the investigative agency lay hidden dangers for the healthy operation of the search system in China.At present,the search system has problems such as lack of procedural starting conditions,generalization of formal search warrant regulations,slightly crude implementation procedures,weak procedural supervision mechanisms and unclear procedural relief systems.China should learn from the experience of extraterritorial search systems,build a judicial,sophisticated and safeguarded search system,proceeding from China’s judicial reality,reconstruct the systematic types of search procedures,refine the applicable norms of search procedures,strengthen the external supervision mechanism of search procedures,and build the procedural relief mechanism and procedural sanction mechanism for the counterpart to improve the criminal search system,protect the rights of counterparties and maintain procedural justice.
