摘　　要：商业秘密作为一种无形的经济财富,一直是激烈的市场竞争中保持不败的“秘密武器”。权利人通过采取保密措施所保护的技术信息和经营信息,对企业的生存以及提高竞争力具有重要意义。国外的企业在进入中国市场的商业战斗中采取了大量的商业秘密保护手段,以保证其在市场上的核心竞争力。然而我国很多用人单位在保护商业秘密的意识上相对淡薄,造成了大量的隐患。由于我国商业秘密保护的相关法律规定制定较晚,导致其在立法和执法方面还有所欠缺。在分析我国人才流动和商业秘密保护现状的基础上,指出我国在立法、执法方面的不足,并针对性地提出相关建议,对完善我国在人才流动中的商业秘密保护具有借鉴意义。As a kind of invisible economic wealth,the commercial secret has always been an undefeated"secret weapon"in the fierce market competition.The technical information and business information protected by the right holder through confidential measures are of great significance to the survival of enterprises and the improvement of competitiveness.In order to ensure the core competitiveness in the market,foreign enterprises have taken a large number of measures of commercial secret protection in the commercial battle after entering the Chinese market.However,many employers in China have relatively weak awareness of protecting commercial secrets,causing a large number of hidden dangers.Due to the late enactment of relevant laws and regulations on the protection of commercial secrets in China,there are still deficiencies in legislation and law enforcement.Based on the analysis of the current situation of talent flow and the protection of commercial secrets in China,this paper points out the defects of legislation and law enforcement in China and puts forward relevant suggestions,which is of great referential value to the improvement of the protection of commercial secrets in the talent flow in China.
