摘 要:伴随着我国平台经济、共享经济、数字经济的蓬勃发展,其中电子商务、网络约车、网络送餐、快递物流等新业态经济吸纳了大批的劳动力就业创业。在当前法律关系复杂、劳动关系判断标准滞后的情形下,采取"扬长避短、避重就轻"的方法,倒逼用工单位主动确认劳动关系,或者绕开劳动关系门槛按特殊参保主体而先行先试,创新地将新业态用工纳入到工伤保险参保范围。With the rapid development of platform economy,sharing economy and digital economy in China,e-commerce,online car hailing,online meal delivery,express logistics and other new business forms have absorbed a large number of labor employees.In the current situation of complex legal relations and lagging labor relations judgment standards,we should adopt the method of"promoting strengths and avoiding weaknesses"to force the employing units to take the initiative to confirm the labor relations,or bypass the threshold of labor relations and participate in insurance according to special subjects,so as to bring the new type of employment into the insurance scope of industrial injury insurance creatively.
