认罪认罚从宽制度赋予被害人独立量刑参与权的相关问题解析

摘　　要：被害人权利保障问题是认罪认罚从宽制度的一个难点,被害人陈述意见的依附模式不能满足被害人权利保障的需要。赋予被害人独立的量刑程序参与权,使其享有独立的量刑建议权,是被害人权利保障的出路。对于被害人应否享有独立的量刑参与权虽有质疑与担忧,但赋予被害人独立量刑参与权确有必要,且具有相应的法理依据。菜单选择的量刑参与模式非但不会减损认罪认罚从宽制度的效率功能,还可能促进效率的提升。赋予被害人独立量刑参与权,法律后果明晰,有利于定纷止争,不会“绑架”公诉权。认罪认罚从宽制度的公力合作模式可以兼容加害人与被害人的私力合作,不会导致冲突和内耗。The protection of the rights of the victims is a difficult point in the leniency system of pleading guilty and punishment.The attachment mode of the victims'opinions cannot meet the needs of the protection of the rights of the victims.It is the way to guarantee the victim's rights to endue the victim with the independent right to participate in the sentencing procedure and to make him enjoy the independent right to propose the punishment.Although there are doubts and concerns about whether the victim should enjoy independent participation right in sentencing,it is necessary to endue the victim with independent participation right in sentencing,and there is corresponding legal basis.The menu choice of sentencing participation model will not detract from the efficiency function of the leniency system of pleading guilty,on the contrary,it may also promote the improvement of efficiency.The legal consequences of the victim's right to participate in sentencing independently are clear,which is conducive to settling disputes and not"kidnapping"the right of public prosecution.The public power cooperation model of the lenient punishment and confession system can be compatible with the private power cooperation between the perpetrator and the victim,and will not lead to conflict and internal consumption.
