传染病防治失职罪疑难问题研究

摘　　要：当前,关于传染病防治失职罪问题的疑难点,主要是主体范围过窄、难以认定,主观罪过形式是否包括间接故意,以及刑罚配置明显体现出罪刑失衡和轻刑化等三个问题。对于传染病防治失职罪的主体范围过窄、认定难问题,存在通过新公务说的观点思路对国家机关工作人员的主体性质进行探讨,以及从立法上将渎职罪的主体从国家机关工作人员修改为国家工作人员两条解决路径。关于传染病防治失职罪的主观方面,该罪的主观罪过具有单一性,即只能由过失构成,不能包括间接故意。至于传染病防治失职罪的罪刑失衡和轻刑化问题,解决路径主要是对该罪的法定刑进行立法完善,即增加一档“情节特别严重的,处三年以上七年以下有期徒刑”的量刑档次。At present,there are three problems concerning the crime of dereliction of duty in the prevention and treatment of infectious diseases,namely,the narrow scope of subject and the difficulty in identification,whether the subjective form of fault includes indirect intention,and the imbalance and leniency of punishment in the allocation of punishment.As for the first problem,there are two ways to discuss the nature of the staff of state organs from the new perspective of official busines,and to change the criminal subject from the staff of state organs to the national staff from the perspective of legislation.As for the subjective aspect of the crime,the subjective fault of the crime has a single character,that is,it can only be constituted by negligence,not including indirect intention.As for the imbalance and lightening of the punishment,legislation should be improved for the statutory punishment for the crime,and the sentencing grade of"if the circumstances are particularly serious,the punishment shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years"should be added.
