法治乡村建设的难题及其破解策略

摘　　要：“法治乡村”建设目标的提出,充分说明了国家对法治乡村建设的重视。法治乡村建设是乡村法治思维培育、乡村良法体系建构和乡村干部群众普遍遵守良法的系统工程。综观我国乡村法治现状,尚有乡村人伦思想与法治思维存在抵牾、村规民约与国家法律存在冲突、乡土行为与法治方式存在张力等难题。这些难题可通过以下策略予以破解:1.调适与重塑思想观念,培育乡村法治思维;2.弥合与完善相关制度,构建乡村良法体系;3.转变和规范乡土行为,促使乡村干部群众普遍遵守良法。The proposal of the goal of“the rule of law in rural areas”indicates the importance attached to the rural construction under the rule of law in our country.It is a systematic project of cultivating the thinking of rule of law,constructing a good law system,and the rural cadres and masses abiding by good laws.In a comprehensive view of the current situation of the rule of law in rural areas,there are still some difficulties,such as the contradictions between the rural thought of human relations and the thinking of rule of law,the conflicts between village regulations and national laws,and the tension between rural behaviors and rule of law.These problems can be solved by the following strategies:firstly,adjust and reshape ideas to cultivate rural thinking of the rule of law;secondly,bridge and improve relevant systems to build a rural good law system;and thirdly,change and standardize rural behaviors to make the rural cadres and masses abide by good laws.
