高校学术不端治理权的来源、本质及其行使机制

摘　　要：学术不端治理是高校思想政治工作的重要内容。高校学术不端治理权来源于法律法规的授权,属于高校办学自主权的一部分,治理权的行使主体是高校学术委员会,内容既包括治理学术不端,也包括保护学术自由。合法、高效地追究学术不端行为人的责任是高校学术不端治理权的基本行使机制;平衡治理权和治理对象的权利是依法治理学术不端的运行机制,同时也是高校学术不端治理权的规范行使机制。Governing academic misconduct is an important part of ideological and political work in colleges and universities. The power to govern academic misconduct in colleges and universities comes from the authorization of laws and regulations and belongs to a part of the autonomy in running colleges and universities. The main body of the power to govern academic misconduct is the academic committee of colleges and universities. The content of the power to govern academic misconduct includes not only governing academic misconduct,but also protecting academic freedom. Legal and efficient accountability is the basic exercise mechanism of the power to govern academic misconduct in colleges and universities. Balancing the power to govern academic misconduct and the right of the governing object is the operating mechanism of governing according to law,and it is also the normative exercise mechanism of the power to govern academic misconduct in colleges and universities.
