论执行依据不明的救济机制——基于当事人权利保障的视角

摘　　要：如果执行机构据以执行的根据不具备明确、具体的要求,会导致执行活动无法进行。执行依据不明救济机制既要研究法院的处理机制问题,也要兼顾当事人的权利救济问题。对人民法院民事裁判不明,应构建复议与再审相结合的权利救济体系;对仲裁裁决不明,应当设置与判决不同的权利救济制度,将主文不明列入可撤销范畴。If the basis does not have the clear and specific requirements,the execution agency will not carry out the activity on that basis.The relief mechanism of unresolved implementation not only requires the study on handling mechanism of the court,but also considers the right relief of party.For the indeterminacy of civil judgment of the people’s court,the right relief system should be established combining reconsideration and retrial.For the indeterminacy of arbitration award,different right relief system from sentence should be set up,and the indeterminacy of main text should be included in revocable category.
