机构改革背景下行政诉讼被告的确定——以保密行政机关改革为样本的分析

摘　　要：此次机构改革,对保密行政机关而言完全实现了党政合一,在管理体制上归口党委办公厅(室)管理,形成了"一套人马,多块牌子"。在此种情况下,保密行政机关能否作为行政诉讼的被告、如何参与诉讼、如何具体承担法律责任值得进一步探讨。只要还保留有保密行政机关的牌子,其就可以用自己的名义独立实施保密行政行为,当然具有行政诉讼被告的资格。在地方保密行政机关没有独立编制的情况下,由党委办公厅(室)副主任兼任保密行政机关负责人参与行政诉讼法律依据不足,应尽快弥补任命程序上的缺陷。党委办公厅(室)的编制中应该有专门从事保密行政管理工作的独立编制。在对外承担国家赔偿责任时,首先以党委办公厅(室)总体经费中的保密运行经费承担,如不足以承担,则以全部经费承担。This institutional reform has fully realized the unity of the party and the government for the secrecy administrative organ and the secrecy administrative organ has been managed by the Party Committee General Office,forming"one team,multiple brands."Under the circumstances,further discussion is needed about whether the secrecy administrative organ can be used as the defendant of the administrative litigation,how it participates in the litigation and how it specifically assumes the legal responsibility.As long as its brand is retained,the secrecy administrative organ can independently implement the confidential administrative act in its name and certainly the qualification of the defendant in the administrative litigation.When the local secrecy administrative organ has not been independently established,one as both the deputy director of the Party Committee General Office and the director of the secrecy bureau gets involved in the administrative litigation,which has defects on the legal basis.And the defects in the appointment procedure shall be corrected as soon as possible.In addition,the preparation of the Party Committee General Office should contain an independent preparation for the specialized work of secrecy administration.The confidential operating funds of overall budget from the Party Committee General Office shall first undertake the state’s liability for compensation and if confidential operating funds are not enough,the overall funds shall assume the responsibility.
