法律硕士教育制度需要革命性的变革

摘　　要：法律硕士教育出现的问题在现有的制度框架内依靠各培养单位的教学改革已经无法解决,需要从上层的制度设计进行革命性变革。首先,将法律硕士的报考对象限制为已经通过国家法律职业资格考试的人员。其次,入学考试重在考察学生的文字表达能力和语言表达能力。第三,将学生作为实习律师注册在实务导师所在的律师事务所。第四,按照案件类型设置课程,打破实体法和程序法的界限。第五,设立实务导师和论文导师双导师制。第六,将毕业论文撰写作为培养法律实务专家的途径。The problems of JM(Juris Master)education cannot be solved by the teaching reform of each training unit in the existing system framework,so it is necessary to make revolutionary change from the system design of the upper level.First of all,the entry of JM is limited to those who have passed the national legal profession qualification examination.Secondly,the entrance examination focuses on the students’ability of language expression.Third,students are registered as trainee lawyers in the law firm where the practice tutor works.Fourth,set up curriculum according to the type of cases,break the boundary between substantive law and procedural law.Fifth,set up double tutorial system of practice tutor and thesis tutor.Sixth,take the graduation thesis writing as a way to train legal practice experts.
