摘 要:这次研讨会主要聚焦于疫情背景下集体合同与劳动合同的效力冲突问题,尤其是通过集体协商降低劳动者薪酬待遇的合法性依据问题。对此,与会者从法理解读的角度分别提出职工民主协商说、补充说、特别法说、"更有利原则"说、工资调整机制说、劳动合同变更汇总说、特定情形下对劳动合同不利变更说、不可抗力情形下特殊应对说、集体合同生效后于劳动合同说等观点,并就效力冲突问题对集体协商和集体合同立法及法律实务的启示进行了深入的探讨。This seminar mainly focuses on the conflict between collective contract and labor contract in the epidemic situation,especially the legitimacy of reducing workers’ remuneration through collective negotiation.In this regard,from the perspective of legal interpretation,the participants put forward the views of employee democratic consultation,supplement,special law,"more favorable principle",wage adjustment mechanism,summary of labor contract changes,adverse change of labor contract under specific circumstances,special response under force majeure,collective contract after labor contract comes into effect,etc.The seminar discusses the legislation and legal practice of collective negotiation and collective contract and its reference and inspiration.
