摘　　要：为加快调查行为法治化进程,建立反腐败长效机制,职务犯罪调查亟待走出所面临的诉讼困境。监察机关在权力领导层面是政治机关,但职务犯罪调查承担刑事诉讼参与职能,应当受到刑事诉讼制度的规范。目前,职务犯罪调查仍存在着人身自由限制大幅强化、职务违法调查与犯罪调查区分不明、外部法律监督缺位等问题。因此,应将刑事诉讼原则适用于职务犯罪调查,并参照《刑事诉讼法》构建犯罪调查的证据规则体系;将职务违法调查与犯罪调查在立案程序方面作出适度区分;由人民检察院承担职务犯罪调查权的事中审查与事后救济职责,以期实现职务犯罪调查的法治化。In order to speed up the process of investigation under the rule of law and establish a long-term anti-corruption mechanism,the investigation of duty crimes urgently needs to get out of the litigation dilemma.The theoretical basis is that the supervisory organ is a political organ at the level of power leadership,but the investigation of job-related crimes should be regulated by the system of criminal proceedings.At present,there are still some problems in investigations of duty crime,such as the restriction of personal freedom,unclear distinction between investigations of duty crime and criminal investigations and absence of external legal supervision.The specific countermeasures are as follows.First,apply the principle of criminal procedure to the investigation of duty crimes,and improve the evidence rules of criminal investigation with reference to the criminal procedure law.Second,the investigation of duty violation and the investigation of crime should be appropriately distinguished in terms of filing procedures.Third,the people’s procuratorates shall assume the investigation power of office-related crimes in order to realize the investigation of duty crimes under the rule of law.
