《公安机关办理行政案件程序规定》修改决定的“快速办理”理解与适用分析

摘　　要：从行政执法习惯的角度来看,越是具体的、具有可操作性的规定就越具有适用的优先性,新颁布的《公安部关于修改〈公安机关办理行政案件程序规定〉的决定》就偏重于较为具体、可操作性强的行政执法实施规定,尤其是新增"快速办理"的性质定位和适用范围,符合当前基层公安工作的实际需要,将会对公安机关行政执法办案产生深远的影响。然而,在对"快速办理"相关条款的适用过程中,亟须解决好简化取证形式所面临的诉讼风险以及未明确简化审核审批内容等问题,才能更好地达到快速办理机制设立的目的,从而进一步规范公安机关办理行政案件的程序,切实提高办案质量与执法水平。From the perspective of administrative law enforcement habit,the more specific and operable,the rules will be more applicable.The newly issued on Modifying by the Ministry of Public Security will focus on more specific,strong operability of the administrative law enforcement implementation rules,especially the new "fast-track" the nature of the orientation and scope of application,conforms to the actual needs of the current grass-roots public security work,will be far-reaching influence on the public security organ administrative enforcement of law case. However, on the application of the relevant provisions of "fast-track" process,be solved well simplified form of forensics faces litigation risk and uncertain problem such as simplified review the content of examination and approval,to better achieve the purpose of rapid conduction mechanism is set up,thus further standardizing the procedures of public security organ for administrative cases of case and improve the quality and level of law enforcement.
