文件制成时间鉴定证据应用现状的统计研究--以中国六市为例

摘　　要：文件制成时间的鉴定难度较大、业内争议较多,因此法院对此类证据的采信往往保持谨慎的态度。通过检索网上公开的有关案例,对北京、广州、上海、深圳、天津、重庆六个城市涉及文件制成时间鉴定的560份裁判文书进行统计分析,着重分析了案件性质、鉴定机构、鉴定项目、鉴定意见表述形式、出庭作证等情况,从宏观上了解了当前文件制成时间证据的使用现状,并就存在的若干问题进行了探讨。In recent years,more and more cases involve the identification of the time when documents are made. Due to the difficulty of identification and the dispute in the industry,the court tends to maintain a cautious attitude towards the acceptance of such evidence.Made time in order to understand the file appraisal evidence of specific usage,by searching online publicly about the case of the supreme people’s procuratorate,in six following cities like Beijing,Guangzhou,Shanghai,Shenzhen,Tianjin,Chongqing,involves files made time appraisal carried out a statistical analysis on 560 copies of the written judgment,this paper analyzes the nature of the case,the authentication institutions,appraisal project and appraisal opinion expression,testify,and so on,from the macroscopic evidence to understand the current file on time the use of the status quo,and problems are discussed in this paper.
