论反腐败国际刑事司法合作中的外交承诺  

On Diplomatic Commitment in International Criminal Justice Cooperation

摘　　要：外交承诺指在国际刑事司法合作中,请求国基于被请求国的要求,向被请求国作出的关于保证被请求人在回国后在刑事追诉、刑罚裁量、诉讼权利等方面保障的承诺。外交承诺包括量刑承诺、追诉承诺、禁止酷刑的承诺、保障外逃人员诉讼权利的承诺。当前,我们应当通过以下途径加强外交承诺的适用:通过立法明确规定作出外交承诺的法律程序;立法上尽快废止死刑,司法上限制死刑的适用;加强我国刑事法治建设、提高国际社会对于我国法治的信任度;加强外交承诺与我国刑事诉讼的具体联系,体现外交承诺对于我国刑事诉讼的拘束力。Diplomatic Commitment is made by the requesting country to the requested country to guarantee the protection of the requested person in criminal prosecution,criminal discretion,litigation rights and other aspects after he returns to China in the international criminal justice cooperation.Diplomatic commitment includes sentencing commitment,prosecution commitment,prohibition of torture commitment,and guarantee of procedural rights of flight personnel.We should strengthen the application of diplomatic commitment in the following ways:stipulate the legal procedure of making diplomatic commitment through legislation;abolish the death penalty as soon as possible in legislation and restrict the application of death penalty in judicature;strengthen the construction of rule of law in criminal law in China and improve the trust of International community in the rule of law in China;strengthen the specific connection between diplomatic commitment and criminal proceedings in China,and reflect the diplomatic commitment’s binding force to criminal procedure in China.
