我国在家教育蕴涵的法律价值分析

摘　　要：《中华人民共和国义务教育法》的颁行以及相关政策文件的规定,造成义务教育法律制度框架下在家教育行为的合法性危机。从法律价值维度来看,儿童的全面自由个性化发展是在家教育的终极法律价值,自由与公平是核心法律价值,秩序是基础法律价值,正义是基本法律价值。充分发挥在家教育现象蕴涵的法律价值的指向功能,促进在家教育法律事实中新的法律关系的生成,有助于实现在家教育的实质合理性与形式合法性统一,最终解决在家教育行为的合法性问题。The promulgation of"Compulsory Education Law of the People's Republic of China"and the provisions of relevant policy documents have caused the legitimacy crisis of homeschooling under the framework of compulsory education legal system.From the perspective of legal value,children's all-round,free,personalized development is the ultimate legal value of homeschooling,freedom and fairness are the core,order is the basic legal value,and justice is the fundamental legal value.Giving full play to the direction function of the legal value implied in the phenomenon of homeschooling and promoting the generation of new legal relations in the legal facts of homeschooling will help to realize the unity of substantive rationality and formal legitimacy of homeschooling,and finally solve the problem of legitimacy of homeschooling.
