摘 要:在我国,民事诉讼有独立请求权第三人制度已取得较为丰硕的理论和实践成果。相较之下,行政诉讼有独立请求权第三人制度却尚未建立,根本原因是民事诉讼有独立请求权第三人制度对相关概念和规定的长期独占,窄化甚至阻却了行政诉讼有独立请求权第三人制度的“自我认同”和研究空间。这既不利于完善我国行政诉讼体制机制,又与国际先进经验背道而驰。有必要构建行政诉讼有独立请求权第三人制度,在进行可行性分析的基础上,提出具体的构建方案。In China,the third party system with independent claims in civil litigation has achieved fruitful theoretical and practical results.In contrast,the third party system with independent claims in administrative litigation has not yet been established.The fundamental reason is that the third party system with independent claims in civil litigation has a long-term monopoly on related concepts and regulations,narrowing or even preventing the independence of administrative litigation.The“self-identification”and research space of the third-party system of claim rights.This is not conducive to perfecting Chinese administrative litigation system and mechanism,but also runs counter to the advanced international experience.It is necessary to construct a third party system with independent claims in administrative litigation,and on the basis of feasibility analysis,propose a specific construction plan.
