摘　　要：在三权分置模式下,土地承包经营权承载着土地的保障功能和财产功能。土地经营权剔除了土地的保障功能,显化了土地的财产功能。土地承包经营权和土地经营权承载着不同的制度功能,这可能是准确理解土地经营权制度的根本,否则可能导致对土地经营权性质和功能的扩张解释。土地经营权的流转包括出租、入股等方式。基于不同方式设立的土地经营权的性质并无不同,土地经营权的性质是债权。以土地经营权融资担保的,其性质是抵押。Under the mode of“Three-Right Separation”of rural land,the contracted management right of rural land carries the function of landsecurity and property.The management right of rural land eliminates the security function of land and shows the property function of land.The contracted management right of rural land and the management right of rural land bear different system functions,which is the basis of accurately understanding the management right of rural land system,Otherwise it may lead to expansion of the nature and function of the management right of rural land.The forms of transfer of management right of rural land include renting,contributing as share or other forms.There is no difference in the nature of rural land management rights based on different ways.The nature of management right of rural land is creditor’s rights.The nature of financing secured by the management right of rural land is mortgage.
