国籍观念在晚清中国的生发与实践

摘　　要：论文在参考已有研究的基础上,对近代国籍观念在晚清中国的形成、发展过程以及制度实践做了进一步探究。通过考察国籍相关概念在中国传统法律中的思想因子与呈现方式,鸦片战争以降通商口岸地方官民对西方国籍制度的接触所引发的国人国籍意识的初步萌发,西法东渐背景下国籍法知识的早期引介、传播与运用,清末中国社会国籍意识高涨背景下清政府的具体因应等内容,进一步丰富了对近代国家转型过程中由国籍问题引发的复杂历史细节的认识。Based on the existing studies,this paper further explores the formation,development process and practice of the modern nationality concept in the late Qing Dynasty.Through examining factors of thought and presentation of the nationality concept in Chinese traditional laws,the emergence of the nationality consciousness caused by the contacts of local gentry at the trading ports since the Opium War with the Western nationality system,the early translation,dissemination and application of the nationality law against the background of the Western laws introduced to China,and the concrete responses of the Qing government in the context of the upsurge of nationality consciousness in the late Qing society,the author further enriches the understanding of the complicated historical details caused by the nationality issue in the transition of modern countries.
