摘 要:2020年5月,全国人大十三届三次会议通过了《中华人民共和国民法典》。民法典物权编虽然以2007年版《物权法》为基础并进行了修改和完善,但延续了以往对地役权的基本规定,这在今后的司法实务中将难以避免地役权纠纷案件裁判发生误解误判的现象。究其原因,就在于民法典未清晰表达地役权登记对抗规则、从属性规则以及不可分性规则的内涵及其逻辑关系,从而极易导致地役权规则间的冲突。为了消除地役权规则间的冲突与混淆,未来修改和完善法典时,应当厘清地役权登记对抗规则、从属性规则以及不可分性规则间的位阶关系、调整范围以及法律效力,对相应条文予以清晰表达和阐释,以实现规则间的有机协调。In May 2020,the Third Session of the 13 th National People’s Congress passed the Civil Code of the People’s Republic of China.Although the real right part of the Civil Code has been revised and improved on the basis of the 2007 edition of the Property Law,it keeps the basic provisions on easement in the past,which will inevitably lead to misunderstanding and misjudgment in the judgment of easement disputes in future judicial practice.The reason is that the Civil Code does not clearly express the connotation and logical relationship of confrontation rules,subordination rules and indivisibility rules in easement registration,which easily leads to conflicts between easement rules.In order to eliminate the conflict and confusion among easement rules in future revision of the civil code,we should clarify the hierarchical relationship,adjustment scope and legal effect among easement registration confrontation rules,subordination rules and indivisibility rules,and clearly state and explain the corresponding provisions so as to avoid conflicts between the rules.
