摘　　要：随着网络的高速创新发展和商业应用模式的迭代演进,网络著作权侵权行为呈现出形态多样、手段隐蔽、分工细致、产业链条化的特征。在司法实践中,网络著作权侵权行为认定从认为网络服务提供者不具备审查义务开始转向考量网络服务提供者的商业模式、恶意程度以及对侵权者的帮助、教唆、管理并获利等因素。网络著作权侵权证明责任分配也开始考量著作权的私权属性、公众享有获取信息的权利、网络服务提供者的发展需求和技术革新之间的利益平衡。为给法院裁判和网络著作权利益相关方提供指引,通过对网络著作权“侵权行为”“过错”等要件事实进行分析,厘清国内外网络著作权侵权证明责任倒置、减轻方法,加强著作权人权利的保护,促使网络服务提供者重视其所负有的审查义务。With the rapid development of network innovation and the iterative evolution of business application mode,the network copyright infringement has the characteristics of various forms,hidden means,meticulous division of labor and industrial chain.In judicial practice,the identification of network copyright infringement has changed from the view that the network service provider does not have the obligation to review to the consideration of the“business model”and“malicious”degree of the network service provider,as well as the help,abetting,management and profit of the infringement.The distribution of the burden of proof of network copyright infringement begins to consider the balance of interests between the attributes of private rights,the right of the public to access information,the development needs of network service providers and technological innovation.In order to adapt to the changes of the times and provide guidance to the court and the network copyright stakeholders,the analysis of the elements of the network copyright“tort”,“fault”and other facts clarify the domestic and foreign network copyright infringement burden of proof inversion and mitigation methods,and improve the understanding of the importance of the network service provider’s obligation to review.
