“以房养老”分类及其法制建构

摘　　要：21世纪前后,城市房产已基本实现市场化。许多老年人既是房产拥有者的身份,同时也是空巢老人的身份,这一部分老年人的养老问题不仅是一个社会问题,还是一个经济问题,“以房养老”作为传统养老方式之外的一种新型养老方式得到了社会的广泛关注。但是,“以房养老”在实践过程中,却日益凸显出相应的法律制度和社会配套政策措施的缺失。老年人选择“以房养老”之后,老年人应如何避免遭受商业欺诈,政府应如何健全相关职责与监督制度、应如何完善相关的法律法规,以保证“以房养老”方式成为一种安全稳定的养老选择,从而使养老这一目前较为急切的社会问题得到较为妥善地解决,值得政府相关部门、社会各界持续而深入的关注与研究。Around the 21 st century,urban real estate has basically achieved full marketization.As many senior citizens are both house owners and dwellers of empty houses,the pension of such senior citizens is not only a social issue but also an economic one.As a new type of pension for the aged in addition to the traditional one,“housing for the aged”has received widespread attention in society.However,in the practice of“housing for the aged”,the shortage of corresponding legal systems has become increasingly prominent.How to avoid the commercial fraud,how to establish and perfect relevant duties and supervision,how to improve relevant laws and regulations so as to ensure that“housing for the aged”becomes a safe and stable choice for the aged,thus the social issue of pension for the aged,which is urgent at present,can be solved properly is worthy of the continuous and in-depth attention and research from relevant government agencies,social circles and academic circles.
