厚植“以审判为中心”长远发展的法文化基础——以检察机关推进“以审判为中心”诉讼制度改革为视角

摘　　要："以审判为中心"的诉讼制度涵盖了整个诉讼过程,无论是公安机关、检察机关还是审判机关,在这一重大诉讼制度改革中应树立并秉持相同的价值,对制度背后的法文化基础做同向再造。然而学界讨论的焦点往往集中于诉讼制度本身,抑或钟情于对刑事诉讼模式本土化构造的研究,对"隐藏"于背后的法文化基础探索相对不足。特别是在新的诉讼模式下,我国司法机关基于改革的需要,职业伦理、司法理念也在发生相应转变,但这一转变正经历"阵痛",一个重要因素即在于传统观念、惯性思维的羁绊。加强对"以审判为中心"诉讼模式法文化基础的研究,特别是把视角聚焦在特定司法机关、司法实践,是非常必要且具现实意义的。基于检察机关前承公安、后启法院的中间环节定位,以及检察文化作为我国法治文化重要构成的典型意义,应将视角定位在检察机关推进"以审判为中心"诉讼制度改革中所面临的理念重塑和文化变迁上,特别是对检察文化如何逾越政治统帅司法的依从性障碍、逾越行政权力主导司法行为的内生性障碍、如何实现与"以审判为中心"诉讼制度改革的有效互动等方面,进而探索如何厚植"以审判为中心"的法文化基础、推动这一新的改革任务并实现我国诉讼制度的积极转型。The"trial centered"litigation system covers the whole litigation process,Whether it is the public security organs,procuratorial organs or judicial organs,In this major litigation system reform,we should establish and uphold the same value and reconstruct the legal culture foundation behind the system in the same direction.However,the focus of academic discussion is often focused on the litigation system itself,or the research on the localization structure of criminal procedure mode,and the exploration of the legal cultural foundation hidden behind is relatively insufficient.Especially in the new litigation mode,the judicial organs in our country are changing their professional ethics and judicial ideas according to the needs of reform.However,this change is experiencing"pains".An important factor is the fetters of traditional ideas and inertial thinking.It is necessary and of practical significance to strengthen the research on the legal cultural basis of"trial centered"litigation mode,especially focusing on the specific judicial organs and judicial practice.Based on the positioning of procuratorial organs as the intermediate link between public security organs and courts,and the typical significance of procuratorial culture as an important component of China’s legal culture,we should focus on the concept remodeling and cultural changes faced by the procuratorial organs in promoting the reform of"trial centered"litigation system,especially how the procuratorial culture can surmount the compliance obstacles and surpass the political commander-in-chief judicial system In this paper,the author tries to explore how to cultivate the legal culture foundation of"trial centered",promote this new reform task and realize the positive transformation of China’s litigation system.
