舆论监督异化现象及其法律治理

摘　　要：以舆论监督异化现象为切入点,分析舆论监督异化具体的表现形式是民意扭曲为多数人的暴政、监督权的滥用导致政治社会生活的无序、舆论监督沦为“舆论审判”。阐释了民主监督正当化行使的缺位加剧了舆论监督异化现象;提出需完善社会舆论立法、提高舆论媒体社会治理法治化水平、构建系统的司法信息公开机制并坚持依法审判等措施,实现社会舆论在合法路径下进行正当有序的监督。Taking the phenomenon of the alienation of public opinion supervision as an entry point,this paper analyzes its specific manifestations:distortion of public opinion into the tyranny of the majority and the abuse of supervision power,which in turn leads to disorder in political and social life,and public opinion supervision reduced to“public opinion trial”.It explains that the lack of proper exercise of democratic supervision has exacerbated the phenomenon of dissimilation of public opinion supervision.It proposes measures to improve the legislation of social public opinions,improve the level of legalization of public opinion media social governance,build a systematic judicial information disclosure mechanism,and insist on adjudication in accordance with the law,so as to realize the legitimate and orderly supervision of public opinions under the legal path.
