摘　　要：村民自治是村民直接管理基层社会事务的活动,村民自治组织则是村民行使自治权的主要平台和依托。当前中国农村中出现了多种基层组织,法律上它们的身份规定不明确,却又或多或少地承担着部分村民自治的功能,这种情况长期存在不仅损害村民自治组织的发展,而且会对乡村治理体系的构建带来危害,最终损害村民自治的权益。因此需要从法律上对村民自治组织的身份给予明确界定,并对村民自治组织的建设和发展做出相应的制度保障和创新。Villagers’self-governance is an activity that the villagers directly manage the community affairs.The villagers’self-governance organization is the main platform and support for the villagers to exercise their autonomy.At present,there were many grass-roots organizations in rural areas of China.Their legal status was not clear,but they undertake more or less functions of villagers’self-governance.The long-term existence of this situation would not only damage the development of the villagers’self-governance organization,but also bring harm to the construction of the rural governance system.Finally,it would damage the rights and interests of villagers’autonomy.Therefore,it was necessary to clearly define the identity of the villagers’self-governance organization in law,and made corresponding system guarantee and innovationed for the construction and developmented of the villagers’self-governance organization.
